Acceptable Use Policy

This policy covers everything Smart Digital Solutions LLC provides through En Contacto. It exists to protect you, other customers, the people whose details pass through the platform, and us.
It forms part of our Terms of Service. Breaking it can lead to your account being suspended or closed. In serious cases we may be legally required to report activity to the authorities.
Fair use
We provide the Services on the basis of normal use for your plan. If your use is far beyond that, we may restrict capacity or ask you to move to a plan that fits. We will not add charges to your account without your agreement.
We are against abuse, discrimination and infringement of anyone's rights, and we expect you and anyone using the Services through you to be too.
You are responsible for your users
You are responsible for what you do with the Services, and for what anyone using them with your permission does. That includes anyone who gets in because your account was not properly secured.
If someone using the Services through you breaks this policy, we may act on the account. Complaints about your activity will go to the contact on your account.
Where the problem can be fixed and immediate action is not needed, we will tell you first and give you a reasonable chance to put it right, as set out in our Terms of Service. We may act immediately in cases of fraud, security risk, unlawful activity, or a legal requirement.
What you must not do
Illegal and infringing material
Do not use the Services to transmit, store or publish anything that breaks the law. This includes material protected by copyright, trademark or trade secret that you do not have permission to use, and anything obscene, defamatory, threatening, or in breach of export control law.
You are responsible for everything you upload or publish, and for having permission to use it.
Spam and unwanted messages
Do not use the Services to send unsolicited bulk or commercial messages.
Do not use them to run unconfirmed mailing or messaging lists. Do not add someone's email address or phone number to a list without their permission. Any list you run using the Services must be confirmed opt-in, and you must be able to show that permission for as long as the list exists.
Do not use purchased email or phone lists with the Services.
This applies to messages sent through the Services and to messages sent from anywhere else that point recipients to something you host with us.
Attacks and interference
Do not use the Services to distribute anything designed to break this policy or another provider's. That includes tools for sending spam, and network sniffing, packet spoofing, flooding, mail-bombing and denial-of-service attacks.
Do not try to access accounts, systems or resources you are not authorised to use. Do not introduce viruses or malicious code. Do not interfere with other customers' use of the Services.
Also prohibited:
- getting or trying to get services from us, or from another provider through us, while avoiding payment;
- accessing, altering or destroying information about our customers or their contacts without authorisation;
- publishing or linking to content that incites violence or threatens anyone's safety;
- anything that breaches consumer protection law; and
- anything that violates a person's privacy.
The Services may not be used by anyone involved in, or suspected of involvement in, illegal gambling, terrorism, narcotics or arms trafficking, or the development or proliferation of nuclear, chemical or biological weapons.
Child sexual abuse material
Publishing, transmitting or storing child sexual abuse material through the Services is absolutely prohibited. We remove it immediately, close the account, and report it to the National Center for Missing & Exploited Children as US law requires.
Rules for digital cards, leads and NFC
Identity and impersonation
Do not create digital cards, public profiles or wallet passes that impersonate any person, company or government body. Do not misrepresent your identity, your credentials, or your connection to an organisation.
We may suspend accounts and take down public profiles we believe are being used for identity fraud, phishing or social engineering.
Leads and contact data
Our tools let you capture contact details from other people. Those details belong to the person they describe.
You are responsible for having a lawful basis to collect, store and contact them, and for complying with data protection law including the GDPR and CCPA.
Do not use our lead capture tools to build data for sale to third parties, or to feed unconfirmed mailing lists.
This applies equally to business cards you scan. The person on that card did not choose to give you their details through us — you are responsible for handling them lawfully.
Wallet passes
Do not distribute wallet passes containing malicious links, deceptive branding or illicit material. Do not try to bypass rate limits, or generate passes in bulk to overwhelm our systems or distribute spam.
Links and NFC
Digital cards hosted with us must not contain links or QR codes leading to malware, spyware, phishing sites or illicit content.
We do not make NFC hardware, but using our software to write malicious payloads to NFC tags is prohibited.
Our name and brand
Do not impersonate us, claim a business relationship with us that does not exist, or claim ownership of anything of ours, in order to gain service, customers or someone's trust.
About this policy
The list above is not exhaustive. It describes the kinds of activity we consider incompatible with the Services.
We may change this policy by publishing a new version. Where a change materially affects your rights, we will give you reasonable notice by email before it takes effect, in line with our Terms of Service. Other changes take effect when published.
